Am I entitled to workers’ compensation?

The majority of all injuries caused by a work-related accident or condition are covered under the Pennsylvania Workers’ Compensation Act. Injuries that occur in the workplace but are caused by a worker’s own intoxication or illegal drug use, or are the result of an injury caused by another person for reasons not related to the job, are not covered. How long can I receive workers’ compensation benefits?

There is no simple answer to this question. Depending on your workplace injury, you could receive benefits for a few weeks or for the rest of your life. Speaking with an experienced workers’ comp attorney is the best first step to determining the potential value of your workers’ comp claim.

Can I receive a lump sum payment?

YES. A lump sum cash settlement is an option that many people pursue in workers’ comp claims. Unfortunately, most injured workers do not realize how valuable their case is and never bother calling the right attorney before negotiating or accepting a lump sum settlement. Don’t make that mistake. Forceful litigation and / or negotiations by an aggressive workers’ compensation lawyer can yield very substantial lump sum settlements.

If I injured the same body part before, can I still get workers’ comp?

YES. When you re-injure a body part on the job, an employer might argue that a pre-existing condition was the cause of the injury. But a worsening claim or a new injury claim can be made if there is an accident in the workplace, or a new injury performing your job duties. Working with an attorney experienced in this type of claim is essential.

Can my workers’ compensation payments be stopped?

YES. It may be against the law for employers or their insurance companies to simply stop paying your workers’ comp benefits. If they file a petition to terminate or modify benefits, however, you may be at risk of losing your payments. If this happens, contact a lawyer immediately.

Do I have to treat with the workers’ compensation insurance company doctors?

Probably Not. If your employer posts a list of company doctors at your workplace, you must see one of those physicians during the first 90 days of treatment. There are exceptions, however, and a knowledgeable workers’ comp attorney can help you work around this requirement so you can see the doctor you choose.

Do I have to attend the “independent medical examination?”

Yes. Under the Pennsylvania Workers’ Compensation Act, employers and their insurance companies are entitled to have you examined by a doctor of their choosing every six months. If you do not attend the examination, the insurance company can file a petition to stop your benefits until you do attend. Protect yourself by getting advice from your workers’ compensation attorney before attending these appointments.

What is an IRE?

An IRE is an Impairment Rating Evaluation requested by an employer’s insurance company once a worker has received total disability benefits for 104 weeks. An independent doctor is assigned by the Bureau of Workers’ Compensation to perform an exam and the benefit status may be changed from total disability to partial disability. If you have received an IRE, you can challenge or appeal the result, but only for a limited period of time. Contacting a skilled workers’ compensation attorney is your best course of action.
